General Litigation

General litigation is the process of solving a dispute by involving the court system.  Below are just a few of the areas of general litigation which the lawyers of McDowell Faulk practice in. One of the most common general litigation cases is  breach of contract. BReach of contract occurs when one or more parties to an agreement fail to follow through on their obligations. Most often, when someone breaks a contract their actions cause harm to the other party. That is where litigation comes in. When a contract is broken we may not be able to make everything the way it was before, but we will do our best to put you in as good a position as possible to move forward.

A person’s property is important to them, and litigation often happens as a result of  property line disputes, that is when there is a disagreement on boundaries or when a neighbor has come over onto your property without permission. These cases have to be filed in the county where the land in question is situated and often require experts like surveyors to provide input and testimony. Our attorneys will protect your property rights by working to stop any incursions on your land, while also seeking a judgment for any damages the incursion might have caused.

Our attorneys routinely handle litigation cases with landlord-tenant issues, such as evictions and ejectments. Evictions occur in District Court and requires there to be a landlord-tenant relationship; there are very specific rules which have to be followed for evictions and our lawyers will make sure all the deadlines are followed and all notices and information given from one party to the other will be in conformity with state law. Ejectments are filed in Circuit Court and are necessary when someone is on a property to which they have no legal right, but won’t leave. This process is more involved than an eviction and requires great skill to ensure the steps are followed correctly, including pleading and filing the case correctly.
